1. Acceptance of terms

By downloading, installing, or using TopHit, you agree to these Terms of Service. If you do not agree, do not use TopHit. We may update these terms from time to time — continued use after changes constitutes acceptance.

2. What TopHit is

TopHit is a mobile video editing application for iOS that allows you to create split-screen videos, add captions, music, and watermarks, and export finished videos to your camera roll. TopHit also includes an AI chat assistant to help with content creation ideas.

3. User content

You retain full ownership of all videos, images, and content you create or import into TopHit. We do not claim any rights to your content. You are solely responsible for the content you create and share using TopHit, including:

• Ensuring you have the right to use any video clips you import
• Respecting copyright when using music or audio tracks
• Complying with platform guidelines when uploading exported videos to social media
• Not creating content that is illegal, harmful, or infringes on others' rights

4. Music and audio

TopHit provides a selection of music tracks for use in your videos. These tracks are licensed for use within TopHit exports. You may use exported videos containing these tracks for personal and commercial purposes on social media platforms. Redistribution of the music tracks themselves, separate from TopHit video exports, is not permitted.

5. AI assistant

TopHit includes an AI chat assistant powered by third-party AI models. The assistant is provided as a creative tool and may:

• Provide inaccurate or incomplete suggestions
• Generate ideas that may not be suitable for your specific use case
• Experience downtime or service interruptions

The AI assistant is not a substitute for professional advice. You are responsible for evaluating and using any suggestions at your own discretion.

6. Acceptable use

You agree not to use TopHit to:

• Create content that violates any laws or regulations
• Produce or distribute harmful, abusive, or hateful content
• Infringe on the intellectual property rights of others
• Reverse-engineer, decompile, or extract the source code of TopHit
• Attempt to bypass any limitations or security measures in the app

7. Intellectual property

TopHit and its original content, features, design, and functionality are owned by TopHit and are protected by copyright and other intellectual property laws. Your content remains yours — we claim no ownership over videos or media you create using TopHit.

8. Disclaimer of warranties

TopHit is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the app will always function without errors, that exports will always complete successfully, or that the AI assistant will provide accurate results. Use TopHit at your own risk.

9. Limitation of liability

To the maximum extent permitted by law, TopHit and its creators shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the application. This includes but is not limited to: data loss, failed exports, corrupted video files, or any content created using the app.

10. Termination

You may stop using TopHit at any time by deleting the application. We reserve the right to remove the app from the App Store or discontinue the service at any time. Upon deletion, all locally stored data is removed from your device.

11. Governing law

These terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles.
